You hereby provide your explicit consent to participate in the Remote Patient Monitoring (RPM) program, offered by LBU- Los Barrios Community Clinic (“Healthcare Provider”), via a digital examination tool platform and mobile application (collectively, the “Tyto Solution”) operated by Tyto Care Inc. (“Operator”). The Tyto Solution allows you (or any other individual on behalf of whom you access to the services) to participate in remote implementation of a clinician-submitted protocol and/or certain notification capabilities in connection with such protocol (collectively with the related services and features, the “Program”) all in accordance with the Tyto Solution Terms of Use and Privacy Policy available at

BY AGREEING TO PARTICIPATE IN THE PROGRAM YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT:

No medical advice by Operator: Operator is not a health care provider  and has no responsibility whatsoever to the medical information and/or protocol, diagnosis, determination, recommendation (including any treatment recommendations and/or notifications), content or any other information provided by or on behalf of the Healthcare Provider or otherwise conveyed via the Tyto Solution or obtained therefrom, nor for any loss, injury, harm and/or damage incurred as a result of, or in connection with, the Program or any implementation or otherwise  usage thereof.

YOU HEREBY ACKNOLEDGE THAT THE PROGRAM IS IN NO WAY A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM A PHYSICIAN, PHARMACIST OR OTHER AUTHORIZED HEALTHCARE PROFESSIONSL, AND IT SHOULD NOT BE USED AS A BASIS FOR ANY DIAGNOSIS OR INITIATION, MODIFICATION OR DISCONTINUATION OF ANY TREATMENT OR CONDUCT. THE PROGRAM IS NOT INTENDED FOR ANY LIFE-SUPPORT, EMERGENCY CARE, OR OTHERWISE TO BE RELIED UPON IN DECIDING OR CONSIDERING ANY IMMEDIATE CLINICAL ACTION NEEDS.

No monitoring or supervising by Operator: The Tyto Solution merely enables a mere conduit between patients and clinicians for communication or medical information. Neither the Program nor the Tyto Solution is intended for, nor offers any, active patient monitoring, nor does it contemplate implementing any treatment or notification protocols requiring timely clinical or other response. The Operator does not monitor nor supervise any content (including without limitation the clinician’s treatment protocol) uploaded, or action or lack of action, by the applicable health service provider or the patients. 

No warranties by Operator: Your use of the Program is at your own risk. The Program is provided “as is” without warranties of any kind, either express or implied, including without limitation warranties of fitness for a particular purpose or non-infringement. For the avoidance of doubt, the Operator expressly disclaims any liability with respect to the correctness, timing, compatibility or otherwise accuracy of notifications provided in connection with and/or as part of the Program.
